State owned enterprises have a large scale and play a core role in the national economy, occupying a crucial position among market participants. These enterprises are leading the development and promotion of digital economy, digital industry, and digital asset evaluation standards for digital enterprises. These standards are not only crucial for the promotion of private enterprises and the social sector, but also extremely beneficial for the preservation and appreciation of digital assets of state-owned enterprises. At the same time, they also promote the high-quality development of the entire digital economy in society, making state-owned enterprises play a leading role in the high-quality development of the digital economy.
The State Council issued the "Guidelines for Compliance Management of Central Enterprises (Trial)" (referred to as the "Guidelines") in 2018, and based on this "Guidelines", officially issued the "Measures for Compliance Management of Central Enterprises" (referred to as the "Measures") in 2022. Compared to the Guidelines, the new Measures are more comprehensive in content, with more prominent requirements for compliance management of state-owned enterprises and significantly strengthened regulatory efforts. Especially in terms of data governance, Chapter 6 of the Measures specifically sets up a chapter on information technology construction, emphasizing that central enterprises should strengthen compliance management information technology construction and highlighting the importance of data protection in the construction of state-owned enterprise compliance systems.
As the backbone of the national economy, state-owned enterprises should take on the leading and exemplary responsibility in enterprise data compliance management.
Establishing a data management system that meets legal requirements is a key step in integrating and activating data resources of state-owned enterprises and optimizing state-owned assets.
According to Article 2 of the Enterprise State owned Assets Law, enterprise state-owned assets refer to the rights and interests formed by various forms of state investment in enterprises. Therefore, data assets formed by state-owned enterprises in the process of operation and management are also part of state-owned assets. With the continuous increase of local debt, both the central and local governments have recognized the importance and urgency of debt risks and resolving responsibilities.
The Opinions of the General Office of the State Council on Further Revitalizing Stock Assets and Expanding Effective Investment (State Council Document No. [2022] 19) proposes key areas and methods for revitalizing stock assets in China's infrastructure and other fields, in response to the current situation of ineffective utilization of stock assets. State owned enterprises in the communication, finance, and public service industries are prone to collecting large amounts of personal information and even state secrets. In the face of these data, the effective content can be properly utilized to avoid data assets being collected and left idle in the form of data islands. If these data assets can be effectively utilized, enterprises can reuse these resources in a legal and compliant manner, thereby increasing their overall income.
